The PUPPY as described above is defined here to be a German Shepherd Dog and embodies the characteristics of the German Shepherd Dog breed. This PUPPY is purebred and is registered with the American Kennel Club and will be registered with our "Litter Letter" name along with our kennel name of "vom Kleinen Hain" and will be registered with a limited registration, which will prohibit breeding and the registering of offspring. Limited registration will be lifted after the dog is 2yrs old and upon proof of an AKC title or Schutzhund title (AKC CGC certificate is NOT a title) and hips/elbows certified clear of dysplasia and current ownership. This will apply only to pups bought as breeding stock. Puppies bought as pets will remain on Limit registration. Remember, you can call your puppy anything you like (call name). Altering the AKC paperwork makes this contract null and void except for the sections of this contract pertaining to Seller's rights and such parts protecting the animal's welfare.
Wanda Brown of Kleinen Hain Kennel, here after the BREEDER, guarantees the above described puppy to be healthy and free of communicable diseases at the time of the sale and has done everything possible to produce healthy sound puppies by raising the PUPPY in the best way possible in regards to diet, exercise, socialization and veterinary care.
The Buyer agrees that all deposits and payments are non-refundable and only one replacement puppy will be offered. This only applies to puppies bought for breeding rights.Upon refusal of replacement puppy no other puppy will be offered and no money will be refunded. Replacement puppy is at the sole discretion of the Breeder and will be from same litter or a future litter of same or of comparable pedigree.
All shipping & crate costs and the health certificate are in addition to the purchase price of your puppy and must be paid in full prior to your puppy turning 8 weeks. Shipping is COD to buyer at the time of delivery. Minimum age to ship is 8 weeks. The Buyer agrees that any and all transportation costs present and future, to and/or from Breeders premises, will be at the cost and sole responsibility of the Buyer. All costs while the Puppy is in the control of the Buyer for food, health care, boarding and any other costs associated with the care and shelter of this Puppy will be the sole responsibility of the Buyer.
The BREEDER does not assume any liability for any injury to said puppy after delivery.
The BUYER agrees to have this puppy examined by a veterinarian within 48 hours of delivery. If the puppy is found to be other than healthy, not related to stress, by the BUYER'S veterinarian, it shall be returned to the BREEDER immediately, along with a statement from the certified licensed veterinarian who examined the pup. The BUYER must provide to the SELLER proof of the examination and all diagnosis with all phone numbers and names of treating Veterinarians prior to return. The general part of this health guarantee ONLY covers internal medical illnesses. This warranty DOES NOT cover parvovirus, since the dog has left my home without parvovirus. DO NOT expose your pup to strange animals until it has had all its shots! This warranty also does not cover intestinal parasites as the pups are de-wormed before leaving the premises and it is up to the new owner to continue the de-worming; which will be done at the vet’s office when they receive their vaccinations.
A health guarantee in no way covers or includes buyer dissatisfaction with the temperament of an animal. Temperament is a product of many things, not simply genetics, and BUYER accepts that much of a puppy's or dog's final temperament or eventual adjustment is determined by the skill and patience of the puppy's owner and how the dog is raised or integrated into the new home/situation. Seller in no way warrants that this dog or pup will meet any specific training objective or achievement standard as desired or expected by Buyer. Goals are great things to have, but one cannot warrant luck, the future, training skill and there myriad other things which must be in place to achieve most goals. The accomplishments of a pup or dog are also largely the result of training and the relationship between owner and dog. These are not things Seller can control, and therefore are not things Seller will warrant.
All appropriate shots for the PUPPY'S age have been given, and a record of this vaccination history is supplied at the time of completed sale. The BREEDER has done everything possible to produce healthy sound puppies by raising the puppies in the best way possible in regards to diet, exercise, socialization and veterinary care. The BUYER agrees to maintain the puppy's health in good condition, and to provide yearly examinations, vaccinations, heart worm test, and any other usual procedures necessary to assure good health.
There are many factors that can influence growth and development, such as diet, exercise, weight gain, etc... The BUYER assumes the responsibility to carry on with the appropriate vaccinations, exercise and feeding schedule, as supplied by the BREEDER. MOST PARTICULARLY, the BUYER agrees to keep the puppy slim throughout its normal growth period. The BREEDER can offer no further guarantees once the care of the puppy is no longer under their control.
Our Working Hip Guarantee:
We offer a genetic working hip guarantee only on puppies we bred and that carry the vom Kleinen Hain name. Your dog must be evaluated between 12-14 months of age, as new findings have become known pertaining to canine hips/elbows and the x-ray outcome for dogs that train and work. True genetic hip/elbow dysplasia will be evident at an early age. However, if the dog is worked hard at an early age, this can and has produced environmentally induced dysplasia due to the severity of the actual work required of the dog. In addition, overzealous or little educated but well-intentioned trainers begin starting the dog into strenuous training at too early an age. In an effort to determine whether a dog is indeed affected with genetic hip/elbow dysplasia, the 12-month guarantee governs the age at which x-rays must be taken. This is a Preliminary certification for your dog at 12 months of age, because OFA will not certify a dog for the record books until it is 2 years of age. However, we feel the 12-month time line is necessary for the purposes of this contract. It is also within the requirements for dogs produced outside the US, such as those in the European countries where dogs are bred and raised with the sole purpose of putting them into work as soon as possible. In Germany, Czechoslovakia and many other countries hip and elbow x-rays are taken and certified at 12 months of age. At the 12-month age, OFA will send you an official OFA Prelim Evaluation. For many of you this will be all you need. If you wish, you may have them retaken at 24 months of age to be certified in the OFA official records for the dog.
The following must be adhered to when having your hip/elbow/elbows x-rays taken:
#1. No Kleinen Hain Kennel pup is to be bred prior to 2 years of age. Our belief is very strong in that they are still too young and growing at this age. In females, this can result in a negative OFA rating if hip/elbows are x-rayed after having produced a litter.
#2. For Female puppies that are coming 12 months of age to have their hip/elbows x-rayed, it is crucial to be very familiar with the cycles of their heat. If they are due to come into heat around the 12 month period, I request that you call and let me know of this, so as to delay the taking of the x-rays for 8 weeks following the end of their cycles. Under no circumstances should a female be x-rayed when she is in heat; Hip/elbow films must not be taken 6-8 weeks either way of the impending cycle as well.
When a female comes into heat, the fluctuation of hormone levels within her body causes her ligaments, tendons, and joints to loosen and become lax. This is in preparation for the body if and when it becomes pregnant. It is not a good time to do x-rays as it can and has changed the outcome of the rating for the dog's hip/elbows. Females who come into heat immediately following taking the films, and which result in a negative hip/elbow rating, will require their hip/elbow films be retaken 8 weeks from end of their estrus cycle.
#3. Hip/elbow films should be taken with dog not sedated. When taking hip/elbow films that will be used for hip/elbow evaluation, this is beneficial to allow the dog to tighten his tendons and ligaments in order to maintain his actual proper bone and joint position. However, your vet must be very experienced in how to position the dog on the table; adept at keeping the dog in the proper position…Your Vet must verify proper alignment of the dog in the films before sending on to OFA to be evaluated. Do not allow them to send in films that are substandard in position quality. Remember; this is your dog and so you should demand good films.
#4. A good quality balanced diet is very important to the proper growth and development of your puppy. Feeding Poor quality dog foods laden with preservatives and grains, as well as zealous but misguided supplementation of vitamins or other
growth producing additives, cause serious problems with bone growth and overall longevity of your growing German Shepherd Dog. Be knowledgeable and very particular as to what is being ingested by your growing dogs.
NOTE: Hip/elbow Dysplasia is now believed to be 1/3 genetic; with other factors being 1/3 environmental and 1/3 feed induced. We require that all Kleinen Hain Kennel dogs be maintained daily on Vitamin C plus either a Glucosamine supplement.
#5. The films MUST be taken by a Veterinarian who is familiar with taking and submitting films to OFA for Certification of hips/elbows. Although it is your right to use the vet of your own choosing, my guarantee requires that, should OFA reject the hip/elbows as being dysplastic, the dog's films must be forwarded to a Veterinarian of my own choosing for a full evaluation of the films and the findings thereof.
# 5a. Due to this requirement, at the time films are submitted to OFA you must include with the films a written request that OFA returns your films; which may be forwarded to Kleinen Hain Kennel for evaluation by my veterinarian.
Evaluation of the films by my veterinarian is for the purpose of obtaining his opinion as to whether he feels the dog in fact does have hip/elbow dysplasia. Occasionally a less than desired rating can be due to other factors, particularly in these slow maturing where the dog may be lacking full muscle tone/skeletal development; as well as mal-positioning of the dog on the table or even the taking of a poor quality films. Position is everything for taking and sending in films to OFA. OFA can only review and certify what is before them, based on what your veterinarian has sent them to be evaluated for that particular dog.
If the dog is positioned poorly, this will reflect in the outcome of your dog's rating for hip/elbows. Therefore, I recommend strongly that you use a Veterinarian who, at the very least has been trained and is accredited in the correct x-ray procedures and techniques for setting up the dog on the table, and who also has many years of knowledge and experience in taking films for submission to OFA. Being accredited also includes having taken the training for knowing and making certain that the x-ray diagnostic equipment is set at the proper guidelines for producing the best and most readable films as well as not over exposing the dog to unnecessary radiation during the taking of the x-rays. If you chose not to follow the above procedures and the dog's hip/elbow rating comes back as unfavorable, a second set of films will be required to be taken on the dog. These films will be taken and submitted to OFA at the owner's expense and taken by a vet of Seller's choosing. Therefore, it is very important to make sure you are using a vet who is knowledgeable and trained in the field of taking hip/elbow x-rays. Your Veterinarian should be well aware of the importance of the items discussed above.
# 5b. In the event there is a question as to the results of the 12-month hip/elbow films of the dog, it is agreed that you let the dog grow and mature to the age of 2 years, with films retaken at the age of 24-26 months. Original films must be sent to Kleinen Hain Kennel where they will be retained for comparison and as a guideline for the progress of the hip/elbows in the dog as it becomes fully mature.

I will ALWAYS GLADLY accept back any pup that I breed or sell. I will need the pup/dogs papers back if given along with all veterinarian records as to the health of the dog. The BUYER hereby agrees that if at any time the Buyer cannot take proper care of the puppy, the BUYER must contact the BREEDER and the BREEDER will have the first choice to either: (a) take the PUPPY back or (b) assist the BUYER in finding a suitable home for the PUPPY. The BUYER is to keep the Breeder apprised of the Buyer's current address and any change of address must be reported in writing within 30 days of said change.
In case that the above-described animal is being abused or neglected by the owner or any person(s) involved with the animal, said animal will be returned to the Seller with all paperwork, in cooperation with the Police, Animal Control Office and/or the Humane Society. There will be no refund to the buyer.
Also once you buy one of my pups; you get me for life! I try to stay in contact with my puppy buyers; checking on the status of my babies & making sure everything is okay with the dog and new owner. I am always available to answer any questions you have in the future; be it breeding questions; whelping questions; general questions; or behavioral questions.
This contract is to be governed by Kentucky laws and any dispute arising from this contract will be litigated in Grayson County, Kentucky. The parties further agree that Kentucky Courts have personal and subject matter jurisdiction for any legal dispute arising from this contract.
This contract is entered into in good faith for the above mentioned consideration and agreed upon by the following parties:
CONFLICT RESOLUTION
Mediation. Buyer and Seller agree to mediate any dispute or claim arising between them out of this Contract, or any resulting transaction, before resorting to arbitration or court action. Mediation fees, if any, shall be divided equally among the parties involved. If, for any dispute or claim to which this paragraph applies, any party commences an action without first attempting to resolve the matter through mediation or refuses to mediate after a request has been made, then that party shall not be entitled to recover attorney fees, even if they would otherwise be available to that party in any such action. Arbitration. If signed below, Buyer and Seller agree that any dispute or claim in law or equity arising between them out of this Contract, which is not settled though mediation, shall be decided by neutral, binding arbitration. The arbitrator shall be a retired civil judge or justice, or an attorney, unless the parties mutually agree to a different arbitrator, who shall render and award in accordance with the laws of the State. Judgment upon the award of the arbitrator may be entered in any court having jurisdiction, and the parties shall have the right to discovery in accordance with the State’s civil code.
In the event any action is brought under this Agreement, the party who substantially prevails shall be entitled to an award of its reasonable attorney's fees. The singular form of Buyer and Seller includes the plural.
The BREEDER neither makes nor implies any warranties or guarantees, expressed or implied, other than those written in the agreement including, without limitation, the warranties of merchantability and fitness. This document constitutes the entire agreement between the Breeder and Buyer with respect to this sale. The Buyer's signature below indicates that he/she has read, agrees and does understand all the conditions of the Sales Agreement and Contract of Sale.
All understandings between the parties are incorporated in this Contract. Its terms are intended by the parties as final and an exclusive expression of their agreement with respect to its subject matter, and may not be contradicted by evidence of any prior agreement or contemporaneous oral agreement. If any provision of this Contract is held ineffective or invalid, the remaining provisions will nevertheless be given full force and effect. Neither this Contract nor any provisions in it may be extended, amended, modified, altered, or changed, except in writing signed by Buyer(s) and Seller(s).

I am always available to answer any questions you have in the future; be it breeding questions; whelping questions; general questions; or behavioral questions.
This contract is to be governed by Kentucky laws and any dispute arising from this contract will be litigated in Grayson County, Kentucky. The parties further agree that Kentucky Courts have personal and subject matter jurisdiction for any legal dispute arising from this contract.
This contract is entered into in good faith for the above mentioned consideration and agreed upon by the following parties:
CONFLICT RESOLUTION
Mediation. Buyer and Seller agree to mediate any dispute or claim arising between them out of this Contract, or any resulting transaction, before resorting to arbitration or court action. Mediation fees, if any, shall be divided equally among the parties involved. If, for any dispute or claim to which this paragraph applies, any party commences an action without first attempting to resolve the matter through mediation or refuses to mediate after a request has been made, then that party shall not be entitled to recover attorney fees, even if they would otherwise be available to that party in any such action. Arbitration. If signed below, Buyer and Seller agree that any dispute or claim in law or equity arising between them out of this Contract, which is not settled though mediation, shall be decided by neutral, binding arbitration. The arbitrator shall be a retired civil judge or justice, or an attorney, unless the parties mutually agree to a different arbitrator, who shall render and award in accordance with the laws of the State. Judgment upon the award of the arbitrator may be entered in any court having jurisdiction, and the parties shall have the right to discovery in accordance with the State’s civil code.
In the event any action is brought under this Agreement, the party who substantially prevails shall be entitled to an award of its reasonable attorney's fees. The singular form of Buyer and Seller includes the plural.
The BREEDER neither makes nor implies any warranties or guarantees, expressed or implied, other than those written in the agreement including, without limitation, the warranties of merchantability and fitness. This document constitutes the entire agreement between the Breeder and Buyer with respect to this sale. The Buyer's signature below indicates that he/she has read, agrees and does understand all the conditions of the Sales Agreement and Contract of Sale.
All understandings between the parties are incorporated in this Contract. Its terms are intended by the parties as final and an exclusive expression of their agreement with respect to its subject matter, and may not be contradicted by evidence of any prior agreement or contemporaneous oral agreement. If any provision of this Contract is held ineffective or invalid, the remaining provisions will nevertheless be given full force and effect. Neither this Contract nor any provisions in it may be extended, amended, modified, altered, or changed, except in writing signed by Buyer(s) and Seller(s).
